Towards a transformative democracy: A South African perspective of a democratic concept given the rationality standard and the separation of powers attitude?

In a current political climate of South Africa’s crisis, the topic forms the backbone for the understanding of the fight between legislature; executive and judiciary. The topic draws from recent judgments and developments of particularly the Constitutional Court and Supreme Court of Appeal.

Mr Nkosinathi Mzolo (Law Lecturer, Rhodes University)

Mr N Mzolo is an aspiring academic and human rights lawyer in the area of public law; specifically researching the issues around the constitutional democracies in general and specifically in African democratic constitutions. He serves as a Disciplinary Committee member (Chairperson and Prosecutor) for South African Football Association under the SAFA UMgungundlovu SAB Regional League. He holds Bachelor of Arts, Bachelor of Laws and Master of Laws qualifications from the University of KwaZulu-Natal. He is a Ph.D. candidate at the Rhodes University where his Ph.D. studies focus on: The essence of the Constitutional Democracy in general and in an African Context: Whether the concept serves the African values as enshrined in African Charter on Human and Peoples Rights and other African founding documents.

Adv. VA Balogun (Constitutional Law Lecturer, UKZN)

Adv. Victoria Balogun is a law senior lecturer and the co-founder of the Access to Justice programme at the University of KwaZulu-Natal, KZN-RSA. She specialises in Sexual and Reproductive Rights Which is an integral part of medical law.  Her work focuses on different aspects or women’s rights and health law. She has a particular interest in sexual and reproductive rights, medical law, human rights, access to justice, disability rights and human and drug trafficking, especially in the African context. She has done consultancy work for various organisations including the UNICEF, UNFPA, CCJD, Street Law, IPLT, Commission for Gender and Equality and the AU.
